These Terms of Service ("Terms") govern your access to and use of 21cigarcompany.com (the "Site") and any purchase you make from us (together, the "Services").
Please read Section 15 carefully. It requires most disputes to be resolved by individual arbitration and limits your ability to bring a class action. You may opt out within 30 days.
By using the Site or placing an order, you agree to these Terms. If you don't agree, please don't use the Site.
1. Who We Are
21 Cigar Company LLC is a Wyoming limited liability company registered to transact business in the State of Florida, operating under the fictitious name 21 Cigar Co. We hold an active Florida Retail Tobacco Products Dealer permit.

2. Who May Use the Services
You must be at least 21 years of age to browse the Site, create an account, or purchase from us. Federal law sets 21 as the minimum age to purchase tobacco products nationwide.
You must also be:
- Located in the United States, at a shipping address in a state we serve (see our Shipping Policy)
- Purchasing for your own personal use, not for resale
- Legally able to enter a contract
By using the Services you represent that all of this is true. We verify age on every order — see Section 5.
We do not sell to minors, and we do not sell for resale. We currently offer retail sales only. We do not hold a Florida Tobacco Wholesale Dealer permit and do not sell at wholesale. If you are a retailer interested in carrying our products, contact us and we'll let you know when that changes.
3. Health Warning
Cigars are not a safe alternative to cigarettes. Tobacco products contain nicotine, which is addictive. Smoking causes serious health conditions, including cancer, heart disease, and lung disease.
Nothing on this Site is a claim that our products are safe, reduced-risk, or beneficial in any way. If you are pregnant, nursing, or have a medical condition, do not use tobacco products.
4. Your Account
You may create an account to check out faster and view your order history. You're responsible for keeping your password confidential and for everything that happens under your account. Tell us promptly at contact@21cigars.com if you believe your account has been compromised.
Please give us accurate information and keep it current. We may suspend or close an account for inaccurate information, suspected fraud, attempted resale, or any violation of these Terms.
5. Age Verification
Every order is subject to electronic age verification before it ships. Verification is performed by a third-party provider using the name, address, and date of birth you supply, checked against public and commercial records. If those records are inconclusive, you may be asked to provide a government-issued photo ID.
We will not complete an order that does not pass verification. See our Age Verification page for how the process works, and our Privacy Policy for how the information is handled.
Age verification at checkout is separate from — and does not replace — the adult signature required at delivery.
6. Products, Descriptions, and Availability
Handmade variation. Our cigars are rolled by hand from natural tobacco leaf. Color, veining, wrapper texture, draw, and burn will vary from cigar to cigar and from box to box. This is inherent to premium handmade cigars and is not a defect. Photographs on the Site are representative, and the product you receive will not be identical to the image.
Origin. Our cigars are hand-rolled in Miami, Florida. We do not sell Cuban cigars or products containing Cuban tobacco. Accessories, packaging, and apparel may be manufactured domestically or imported.
Colors and displays. We can't guarantee that colors shown on your screen match the physical product.
Availability. All products are subject to availability, and we may limit quantities, discontinue products, or restrict sales to any person or geographic area at any time.
7. Orders, Pricing, and Payment
Your order is an offer. Placing an order is an offer to buy. No contract exists until we accept your order by shipping it. We may decline or cancel any order for any lawful reason — including availability, pricing or description errors, failed age or address verification, suspected fraud, quantity limits, or a shipping destination we cannot lawfully serve. If we cancel after charging you, we refund you in full.
Pricing errors. Prices and availability can change without notice. If a product is listed at an incorrect price, we may cancel the order even after you receive a confirmation. We'll contact you first.
Payment. We accept major credit and debit cards through our payment processor, and bitcoin through our self-hosted BTCPay Server instance. You represent that you are authorized to use the payment method you provide.
Bitcoin payments. Bitcoin is priced against USD at the time of checkout, and the quoted amount is valid for a limited window shown at payment. Bitcoin transactions are irreversible and are recorded on a public ledger. Refunds are handled under our Return and Refund Policy and our Privacy Policy explains the privacy implications. You are responsible for sending the correct amount to the correct address within the quoted window; underpayments, overpayments, and payments sent after expiry may require manual resolution.
Taxes. Applicable sales tax is calculated at checkout. State tobacco excise taxes, where they apply, are handled as described in our Shipping Policy.
8. Shipping, Returns, and Cancellations
Shipping, delivery, adult signature requirements, and the states we serve are governed by our Shipping Policy. Claims, returns, refunds, and cancellations are governed by our Return and Refund Policy. Both are incorporated into these Terms.
Title and risk of loss pass to you on delivery to the address you provide.
9. Intellectual Property
The Site and everything on it — the 21 Cigar Co. name and logo, band and packaging designs, product names including Genesis, Epoch V, and Satoshi Reserva, photography, text, and layout — are owned by us or licensed to us and protected by intellectual property law.
You may view and print pages for your personal, non-commercial use. You may not copy, reproduce, modify, distribute, scrape, or create derivative works from any part of the Site without our written permission, and you may not use our marks in a way likely to cause confusion.
10. Reviews and Submissions
If we enable product reviews, comments, or other submissions, you're responsible for what you post. Don't submit anything unlawful, misleading, defamatory, obscene, infringing, or that you don't have the right to share. Don't post on behalf of someone else or claim experience you don't have.
By submitting content, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, and display it in connection with our business, including in marketing. We may edit or remove any submission for any reason, and we're not obligated to publish anything.
Reviews reflect individual customers, not us. We don't endorse them and we're not responsible for their accuracy.
11. Acceptable Use
Don't use the Services to break the law, purchase for anyone under 21, resell our products without authorization, evade our shipping restrictions, submit false information, interfere with the Site's operation, or attempt to access accounts or systems you're not entitled to.
12. Third-Party Services and Links
The Site relies on third-party services including our e-commerce platform, payment processors, age verification provider, and carriers, and it may link to third-party sites. We don't control those services and aren't responsible for their content, practices, or availability. Your dealings with them are between you and them.
13. Disclaimers
The Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We don't warrant that the Site will be uninterrupted, secure, or error-free, or that descriptions and other content are accurate, complete, or current.
Nothing here limits any warranty or right that cannot be limited under applicable law. Some states don't allow certain exclusions, so parts of this section may not apply to you.
14. Limitation of Liability
To the fullest extent permitted by law, 21 Cigar Company LLC and its members, officers, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of your use of the Services or use of our products.
Our total liability for any claim will not exceed the amount you paid us for the products giving rise to that claim.
This limitation applies regardless of the legal theory and even if we were advised of the possibility of the damages. It does not apply to liability that cannot be limited under applicable law.
15. Dispute Resolution and Arbitration
Please read this section carefully. It affects your legal rights.
Talk to us first. Before starting any formal proceeding, email contact@21cigars.com describing the dispute and what you want. Most things get resolved here. Give us 30 days.
Arbitration. If we can't resolve it, you and 21 Cigar Company LLC agree that any dispute arising out of or relating to these Terms, the Services, or our products will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. Arbitration will take place in Walton County, Florida, or by telephone or video conference, or by document submission, at your election.
Class action waiver. You and we each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative action.
Small claims exception. Either of us may bring an individual claim in small claims court instead of arbitration, if it qualifies.
Injunctive relief exception. Either of us may seek injunctive relief in court to protect intellectual property rights.
Your right to opt out. You may opt out of this Section 15 by emailing contact@21cigars.com with the subject line "Arbitration Opt-Out" within 30 days of your first purchase or first acceptance of these Terms, whichever is earlier. Include your name and email address. Opting out does not affect any other part of these Terms, and we will not treat you differently for doing it.
If any part of this section is found unenforceable, the rest remains in effect — except that if the class action waiver is found unenforceable, this entire Section 15 does not apply.
16. Indemnification
You agree to indemnify and hold harmless 21 Cigar Company LLC and its members, officers, and agents from any claim, loss, or expense (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Services, your violation of law, or your provision of false information — including any misrepresentation of your age.
17. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Subject to Section 15, any action must be brought exclusively in the state or federal courts located in Walton County, Florida, and you consent to the jurisdiction of those courts.
18. Changes to These Terms
We may update these Terms at any time. The current version is always posted here with the "Last updated" date. Changes apply to orders placed after that date. Continuing to use the Site after we post changes means you accept them.
19. General
Entire agreement. These Terms, together with our Privacy Policy, Shipping Policy, and Return and Refund Policy, are the entire agreement between you and us regarding the Services.
Severability. If any provision is held unenforceable, the rest remains in effect.
No waiver. Our failure to enforce a provision isn't a waiver of it.
Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
Force majeure. We're not liable for delays or failures caused by events beyond our reasonable control, including carrier disruption, severe weather, supply interruption, or changes in law.
